"This is a closed hearing for a wiretap warrant on the residence of Annalise Keating, due to the corroborating testimony of the informant, Asher Millstone. By testifying to the misconduct of Ms. Keating, he will receive full immunity in this case, as well as the closed file entitled "Trotter Lake grand-jury investigation"."

Emily Sinclair first met Asher at the end of season 1. She came to his apartment stating she had some questions in relation to the Sam Keating murder case. She told him that they could do it at the police station if he didn't let her in. Presumably, once inside, she blackmailed Asher into being her unofficial informant into Annalise Keating by threatening to make public what happened at Trotter Lake.

Sinclair had Asher break into the Keating House at night and steal Annalise's voice recorder. She used the audio on it to strategizse in the Hapstall Case and did things like leaking the incest article. After this, she instructed Asher to text her when he knew what Annalise's plan was about the article but he refused to he her mole anymore, despite her threatening to make public what happened at Trotter Lake.

In the days following, Sinclair kept texting Asher threats about making the events at Trotter Lake public information. This cause him to cave and make plans to officially act as her informant. He asked his dad for help and Sinclair drew up immunity paperwork for both of them. The original plan was for Asher to testify in a closed hearing against Annalise in regards to her professional illegal misconduct, but he left when he was called to the stand because he was having trouble focusing as the night before Bonnie confessed to killing Sam.

He returned to Sinclair's office later, stating that he knew more than he originally said. He said he knew who killed Sam and his dad lectured him about knowingly withholding evidence in an ongoing murder investigation. Sinclair drew up new immunity paperwork offering full immunity for the Trotter Lake incident and any connection to the murder of Sam Keating as long as his testimony leads to a conviction. Before Asher signed he spoke with his dad about the David Allen case and he said he did nothing wrong, causing Asher to realise Sinclair drew up immunity paperwork for him as well. Asher never signed the immunity deal as a result.
