- "You killed two innocent women, and you still think you get to complain? Say you'll take the deal! Say it!"
Commonwealth of Pennsylvania v. Solomon was the case that got Annalise's license suspended. Toby Solomon was doing liquid 'G' with an escort, Virginia Michaelson, when she passed out. Toby then left her body outside his apartment and she died of respiratory failure two days later. He went through five attorneys who each told him to take a plea deal, so he fired them because he didn't want to.
Case[]
Annalise was his sixth attorney, joining mid-trial, and asked her class how to repair the case after what the prosecution had achieved. Nobody had anything to say and Annalise was surprised that nobody wanted to take the case, so Michaela took the opportunity to volunteer herself. The next day in court, a tech specialist was on the stand being asked by Renee Atwood about the evidence she was able to obtain from Toby's computer. The specialist testified that Toby hired an escort three times a week and used a blog where he ranked the women based on various sexual elements.
Atwood asked if the specialist found anything else she said there was a selfie. Annalise objected saying that the selfie wasn't disclosed to the defense pre-trial and so was a violation of rule 573. Atwood countered that it was always in the discovery, so Annalise said that if a computer expert is required to comb through discovery she would like to move for a continuance. Judge Rodger Charters reviewed the evidence and called both attorneys to the bench. Annalise accused Atwood of concealing the evidence to which she denied. Charters ruled the evidence was admissible so the tech specialist showed the court the selfie, which was Toby giving a thumbs up with an unconscious Virginia.
After court, Annalise told Connor to have Oliver look into Toby's computer and phone for anything else. She tasked everybody else with preparing Toby for the stand. At the house, Bonnie told Annalise that she should cut a deal with Atwood. She later met with Atwood, and started the conversation by complimenting her for her work with hiding the selfie. Atwood flatly stated she wouldn't be offering Toby any plea deal as payback for the trouble Annalise had caused the D.A's office.
Later, Oliver, Bonnie and Michaela met with Annalise to tell her that Toby had just withdrawn $200,000 from the bank. Annalise and Bonnie went and confronted him outside his house, so he came clean that his previous lawyer was blackmailing him because he killed another girl, Janie Sherwin. Annalise brought Toby back to her office and kicked Michaela off the case. Bonnie left the money in the living room and shut the office door, so Michaela decided to steal $20,000 and go to a casino with Oliver, Connor and Asher. In Annalise's office, Toby explained that he met Janie on the street and Bonnie looked her up and found that she was a runaway. He explained that she insulted him, he got triggered, and beat her to death with a baseball bat and then left her body in a broken freezer in an abandoned warehouse. Bonnie and Annalise didn't know what to do.
Later that night, while in bed with Nate, Annalise told him what was going on. He brought up the record of Jackson Terry, a serial killer, and told Annalise she could say Toby came across him and he confessed to killing Janie. The next day, Toby took the stand and testified to crossing with a man in prison who confessed to killing Janie. Atwood objected, challenging the relevance, and Annalise said it was relevant as it proved Toby was unable to get a fair trial. She presented to the judge proof that Toby was in the same cell block as Jackson Terry. Annalise said Atwood refused to hear her offer the previous day because of her reputation. Later, off camera, a deal was made after Annalise outed Atwood's bias to the judge. Three years if Toby pleaded guilty to involuntary manslaughter. He complained that Annalise said she would get him no jail time, so she slapped him and told him to take the deal.
